Abstract

Comments on the European Court of Justice ruling in Vodafone Ltd v Secretary of State for Business, Enterprise and Regulatory Reform (C-58/08) on the protection of consumers from excessive charges when they use their mobile telephones in other EU Member States. Considers whether the price ceiling and information requirements under Regulation 717/2007 (Roaming Regulation) were validly based on the EC Treaty art.95, and examines the proportionality and subsidiarity of the measure.
