Abstract

This report is a written response to the Law Commission Consultation Paper No.254 - Digital Assets: Electronic Trade Documents. We greatly welcome the proposal on providing legal recognition to the electronic form of the documents that are widely used in international trade and commerce. We are also very pleased to witness that a steady project is underway towards achieving that goal in England and Wales. After examining the full consultation paper, we have however generated some critical views on the provisional proposals as well as the draft Bill. We therefore provide this joint response to the consultation questions and comment on specific provisions of the draft Bill. Details of the content are available upon request sent to the authors.
